A copy of a valid certificate of compliance or relevant occupation certificate must be attached to new residential tenancy agreements.
Selling a property with a swimming or spa pool?
A copy of a valid certificate of compliance, or relevant occupation certificate, or a valid certificate of non-compliance, must be attached to the sales contract.
Buying a property with a swimming or spa pool?
Vendors are now able to transfer obligation of obtaining a 'certificate of compliance' to the purchaser, where a 'certificate of non-compliance' can now be attached to the sales contract.
The buyer of this property has 90 days from the date of settlement to address any issues of pool barrier non-compliance and obtain a certificate of compliance.
Compliance Process - When We Make Your Pool Safe

Swimming pool owners must register their swimming pool or spa pool on the NSW Swimming Pool Register.

Pool owner to book a pool barrier inspection with the local council or an E1 accredited private certifier registered with the NSW Building Professionals Board.

If any areas of non-compliance are found the certifier will write a report outlining the problems & recommended modifications you will have 6 weeks to arrange for appropriate tradespeople to carry out the required work.

Pool owner to book the certifier for re-inspection, in quest to achieve a certificate of compliance.

Importantly - Pool owners must also:

Maintain the pool barrier,

Prevent climbable objects from being placed anywhere near the pool barrier,

Ensure adult supervision of children around the pool.
